Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and Salino Games LLC ("we", "us"), a limited liability company registered in the State of Georgia, United States, and the developer and operator of the mobile game Glowmory (the "Service"). By downloading, installing, or playing Glowmory, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. The Service

Glowmory is a free-to-play memory puzzle game. It is supported by advertising and offers optional in-app purchases (such as Remove Ads, virtual coins, cosmetic tile colors, and boosters). We may add, change, or remove features, content, or game modes at any time, and we may suspend or discontinue the Service (in whole or in part) with reasonable notice where practicable.

3. Virtual items

The game includes virtual items such as "Coins", cosmetic tile colors, and boosters. Virtual items:

• have no real-world monetary value and are not currency or property;
• are licensed to you for use inside the game only, not sold;
• are non-transferable — they cannot be traded, sold, or moved to another account or person;
• are non-refundable, except as required by applicable law or by the refund policies of the app store you purchased through (the Apple App Store or Google Play).

Purchases are processed by the app store you use — the Apple App Store or Google Play — and are subject to that store's terms and refund policies in addition to these Terms.

4. Accounts and fair play

You may maintain one account per player. You are responsible for activity on your account. To keep the game fair and welcoming for everyone, we may remove leaderboard entries and restrict, suspend, or terminate accounts that we reasonably believe are involved in:

• cheating, score manipulation, or exploiting bugs;
• abuse of other players or of the Service;
• offensive, misleading, or impersonating display names.

You can delete your account at any time — see the Account & Data Deletion section of our Privacy Policy.

5. Intellectual property

The game, including its code, design, artwork, audio, names, and logos, is owned by Salino Games LLC and protected by copyright and other intellectual property laws. Some art and audio assets are licensed from third parties, including assets released under the CC0 (public domain dedication) license. We grant you a personal, non-exclusive, non-transferable, revocable license to play the game for your own entertainment. You may not copy, modify, distribute, reverse engineer, or create derivative works from the game except where the law expressly permits.

6. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that your progress will never be lost.

7. Limitation of liability

To the maximum extent permitted by applicable law, Salino Games LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, virtual items, or progress, arising out of or related to your use of the Service. Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid us for the Service in the twelve months preceding the claim. Nothing in these Terms limits rights that consumer protection law grants you and that cannot be waived by contract.

8. Governing law

These Terms are governed by the laws of the State of Georgia, United States of America, without regard to conflict-of-law rules. If you are a consumer residing elsewhere, you keep any mandatory protections of your local law.

9. App store terms

When you obtain Glowmory from a third-party app store or platform (an "App Store"), such as the Apple App Store or Google Play, your use is also subject to that App Store's terms, and the following apply.

Apple App Store. If you downloaded Glowmory from the Apple App Store, you acknowledge and agree that:

• these Terms are between you and Salino Games LLC only, and not with Apple Inc. ("Apple"); Apple is not responsible for Glowmory or its content;
• Apple has no obligation to furnish any maintenance or support services for Glowmory;
• if Glowmory fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Glowmory, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are the responsibility of Salino Games LLC;
• Salino Games LLC, not Apple, is responsible for addressing any claims relating to Glowmory or your use of it, including product liability, failure to conform to legal or regulatory requirements, consumer protection, and intellectual property infringement claims;
• in the event of a third-party claim that Glowmory infringes intellectual property rights, Salino Games LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of the claim;
• you represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not listed on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Google Play. If you downloaded Glowmory from Google Play, your use is also subject to Google Play's Terms of Service, and purchases are processed by Google Play under its terms and refund policies.

10. Changes to these terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and, for significant changes, provide notice in the app. Continued use of the Service after a change means you accept the updated Terms.
